POPIA Notice
Our role as a responsible party and as an operator under the Protection of Personal Information Act, 4 of 2013.
This notice explains how MeterX Online (Pty) Ltd complies with the Protection of Personal Information Act, 4 of 2013 (POPIA) and should be read together with our Privacy Policy.
1. Information Officer
In terms of section 56 of POPIA, MeterX Online (Pty) Ltd has appointed an Information Officer responsible for compliance with the Act. The Information Officer can be contacted at:
- Email: info@meterx.co.za
- Postal address: 19 Market Street, George, 6529, Western Cape
2. Responsible party vs operator
MeterX Online (Pty) Ltd acts in two capacities under POPIA depending on the context of the processing:
- Responsible party — when we collect enquiries through our website, manage our own employees, and process client user accounts for administrative purposes.
- Operator — when we process metering and billing data on behalf of a landlord or other responsible party, in terms of a written services agreement. In this capacity we act only on the documented instructions of that responsible party and apply the security safeguards required by section 21 of POPIA.
3. Lawful conditions for processing
We process personal information in line with the eight conditions set out in POPIA: accountability, processing limitation, purpose specification, further processing limitation, information quality, openness, security safeguards, and data-subject participation.
4. Special personal information
We do not knowingly collect or process any special personal information (as defined in section 26 of POPIA) through the Site or the MeterX platform. We do not knowingly collect personal information of children.
5. Security safeguards
We apply appropriate, reasonable technical and organisational measures to prevent loss of, damage to, or unauthorised destruction or access to personal information — including encrypted transport, role-based access controls, full audit logs of administrative actions, and documented operator agreements with sub-processors.
6. Data-subject rights
Subject to applicable exclusions, data subjects have the right to:
- confirmation of whether we hold personal information relating to them (section 23);
- request a copy of, or the record of, such information;
- request correction or deletion of inaccurate, irrelevant, out-of-date, or unlawfully obtained information (section 24);
- object, on reasonable grounds, to processing of their information (section 11(3));
- complain to the Information Regulator (see section 8 below).
